CGU

ARTICLE 1 : Purpose

The purpose of these “General Terms and Conditions of Use” (GTCU) is to govern the terms and conditions under which the “Site” is made available by the “Publisher” and to define the conditions of access and use by the “User”.

Use of the Site by the User implies acceptance of these GTCU.

These GCU are available on the Site under the heading “GCU”.

ARTICLE 2 : Legal information

Legal information is provided in the “Legal information” section of this Site.

ARTICLE 3 : Definitions

The following terms used in the GCU with a capital letter have the meanings defined below:

Publisher: person designated as such in the “Legal Notice” section of the Site.Services: access on the Site to information relating to the Publisher and its activities.Site: the Internet site published by the Publisher at the address defined in the “Legal Notice” section of this Site.User: any person who uses the Site.

ARTICLE 4 : Access to Services

The Site is accessible free of charge from any location to any User with Internet access. All costs incurred by the User to access the service (hardware, software, Internet connection, etc.) are at the User’s expense.

The Site provides the User with free access to the Services. In the event that the Site allows access to a “Member” or “Partner” area requiring a login and password, this access is governed, in addition to the present GCU, by the general conditions specific to the aforementioned area.

ARTICLE 5 : Intellectual property

Trademarks, logos, signs and any other content on the Site are protected by the French Intellectual Property Code, and more specifically by copyright.

The User must obtain prior authorization from the Publisher for any reproduction, publication or copy of the various contents.

The User undertakes to use the contents of the Site in a strictly private context. Use of the contents for commercial purposes is strictly forbidden.

Any total or partial representation of this Site by any means whatsoever without the express authorization of the Site Editor constitutes an infringement punishable by articles L 335-2 et seq. of the French Intellectual Property Code.

ARTICLE 6 : Personal data

The information entered by the User in the form on the “Contact” page is recorded by the Publisher, who is responsible for processing it, for the purposes of managing any request for information from the User. All fields marked with an asterisk must be completed by the User in order for the Publisher to process his/her request.

Personal data collected in this way is kept for a maximum of 24 months from the date of collection or last contact by the User.

In accordance with the French Data Protection Act no. 78-17 of January 6, 1978, as amended, you have the right to access and rectify any personal data concerning you, as well as the right to object on legitimate grounds. You may exercise this right by contacting the Publisher via this e-mail address.

All requests must be accompanied by valid proof of identity bearing the User’s signature.

ARTICLE 7 : Liability

The Publisher uses its best efforts to ensure quality access to the Services, but does not guarantee the absence of interruption or suspension of access to these services, modification of said services or even stoppage without prior notice, for maintenance or any other reason.

The Publisher declines all responsibility and the User may not claim any compensation from the Publisher in the event of :

interruption, suspension, modification or discontinuation of the Services; inaccuracy, failure to update, error or omission relating to information on the Site; occurrence of bugs; damage resulting from fraudulent intrusion by a third party on the Site;
more generally, direct or indirect damage, whatever the cause, origin, nature or consequences, including in particular loss of profits, customers, data or any other loss of intangible assets, which may arise from any person’s access to the Site or inability to access it, or from reliance on any information obtained directly or indirectly from the Site.The User alone assumes full responsibility for use of the information and content of this Site.

If the User identifies an inaccuracy or error on the Site, he may contact the Publisher by e-mail via the Contact tab.

Any use of the Service by the User resulting directly or indirectly in damage to the Publisher shall be subject to compensation to the latter.

ARTICLE 8 : Hypertext links

The Publisher may provide the User on the Site with hypertext links to other Internet sites for information purposes.

The Editor cannot be held responsible for the services or information provided on these sites, such as advertising, products, services or any other material available on or from these sites or external sources.

The User therefore agrees not to hold the Publisher liable for any damage or loss, whether actual or alleged, arising out of or in connection with the use of or reliance on the content, goods or services available on these external sites or sources.

ARTICLE 9 : Cookies

The User is hereby informed that during visits to the Site, cookies may be installed on his or her browser software, in which case the User will be informed of this by a banner displayed when first accessing the Site, specifying the procedure for deactivating the cookie(s).

Following the appearance of the banner on the Site, the User’s continued browsing implies acceptance of cookies unless the acceptance box has been explicitly ticked.

ARTICLE 10 : Coming into force – Modification of the GCU

The present GTU are in force as soon as they are posted. The Publisher reserves the right to modify these GTU at any time.

Consequently, the User is invited to consult them regularly.

Modifications to the GCU will be effective as soon as they are posted. By continuing to access or use the Site after the posting of the modified GTU, the User will be deemed to have accepted the modifications in question.

ARTICLE 11 : Applicable law and jurisdiction

French law applies to the GCU. In the event of failure to resolve a dispute between the parties amicably, the courts of the Publisher’s registered office shall have sole jurisdiction.
